The Petitioner, Northern Utilities, Inc. ("Northern"), on June 9, 1999, filed an application for a waiver of New Hampshire Code of Administrative Rules, Chapter Puc 500 Rules for Gas Service, Part Puc 505.04(c). This rule prescribes the periodic testing standards for gas meters. Northern requested, inter alia, that the Commission (a) grant Northern a waiver from compliance with the current rules of PUC Part 505.04(c) and, (b) allow Northern to follow the defined, alternative procedure set forth in the attached schedules. Under current rules, periodic tests of meters are required every ten years or every four years, depending on the size of the meter. Under the alternative procedure, the company will test a statistically valid sample of meters. In support of its position, Northern stated that improvements in meter accuracy, and the use of cleaner burning natural gas, supports the use of a statistical sampling methodology in lieu of the present standards.
Based upon the foregoing, it is hereby ORDERED NISI, that Northern's application for a waiver of Rule Puc 505.04(c) is granted; and it is FURTHER ORDERED, that Northern utilize the defined alternative procedure identified as Schedule 1 in lieu of the provisions of Rule Puc 505.04(c).
Order NISI Approving Plan
On July 23, 1999, EnergyNorth Natural Gas, Inc. (ENGI), filed with the New Hampshire Public Utilities Commission (Commission) its Petition for Approval to Extend and Modify the Natural Gas Price Stability Plan. The Natural Gas Price Stability Plan, which ENGI requests to rename to the Guaranteed Price Protection Program (GPPP), allows firm sales customers the option of paying a fixed price for the cost of gas component of the total gas service rates during the winter months. The purpose of the GPPP is to offer customers an option that would provide protection against price fluctuations in the winter season. ENGI proposes to continue to hedge the Gulf Coast and Canadian index-based supply portion of the volumes approved under the GPPP by locking into a price, or series of prices, with one or more of its suppliers.
Based upon the foregoing, it is hereby ORDERED NISI, that the proposed Guaranteed Price Protection Program is hereby APPROVED until such time that ENGI or the Commission determine that the GPPP is no longer appropriate or requires modification.

On April 14, 1998, NHEC filed with the New Hampshire Public Utilities Commission (Commission) a petition seeking an increase in permanent retail rates of approximately $4.68 million or 5.1%, effective July 1, 1998, with supporting testimony and exhibits pursuant to RSA 378 and N.H. Admin. R., Puc Chapter 1600. Subsequently, on April 15, 1998, NHEC submitted a motion requesting that its proposed permanent rate increase be set as temporary rates pursuant to RSA 378:27 for effect on July 1, 1998.

On November 26, 1997, Connecticut Valley Electric Company, Inc. (CVEC or the Company), filed with the New Hampshire Public Utilities Commission (Commission) its proposed Fuel Adjustment Clause (FAC), Purchased Power Cost Adjustment (PPCA) and Short-Term Energy Purchase Rate. The filing included proposed tariff pages to be effective for bills rendered on or after January 1, 1998: 15th Revised Page 17, 12th Revised Page 18, 10th Revised Page 50, and 7th Revised Page 51.
In addition, the Company's proposal includes revised Pilot tariffs due to changes in the costs upon which the FAC and PPCA charges are based so that Pilot customers are neither advantaged nor disadvantaged with respect to regular bundled tariff customers. Revised Pilot tariff pages are: 4th revised Page 53, 54 and 55; 3rd revised Page 56, 57, 58, 59, 60, 61, 62, 63, 64, 65 and 66. The Office of Consumer Advocate (OCA) is a statutorily authorized intervenor.
