On December 26, 1996, in Decision No. 59943, the Arizona Corporation Commission (“Commission”) adopted rules which provided the framework for the introduction of retail electric competition in Arizona. These rules are codified at A.A.C. R14-2-1601 et seq. Competition in the retail electric industry is to be phased-in beginning in January 1999.

The Commission initiated the present rulemaking to modify Articles 2 and 16 of the Arizona Administrative Code to provide the details of the structure and process of that competition in order to meet the target date of January 1, 1999 and to ensure the reliability of the electric system during the transition to competition.
